1. Intellectual Property Rights
All content on this website, including but not limited to text, graphics, logos, original video footage, and images (the “Content”), is the exclusive property of Live Migrations and is protected by United States and international copyright, trademark, and intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, and revocable license to access and view the Content solely for personal, non-commercial, and educational purposes. You strictly may not download, reproduce, redistribute, modify, stream, or exploit any video or image content for commercial use or public display without prior written authorization from Live Migrations. Unauthorized use of any Content may violate copyright laws and result in legal action.
2. Online Store, Order Processing, Fulfillment, and Shipping
Third-party order processing and fulfillment. Merchandise offered through our online store is produced, processed, and fulfilled by Printful, a third-party print-on-demand and fulfillment provider. Live Migrations does not manufacture, warehouse, package, or ship merchandise and does not maintain physical inventory of products offered through the online store. Orders placed through our website are transmitted to Printful for production and fulfillment. Printful may also process payments and other information associated with your order through its systems and third-party service providers.
By placing an order through our online store, you acknowledge and agree that your purchase involves third-party services provided by Printful and that your order may be subject to Printful’s applicable terms, policies, and procedures.
Customer information. You do not need to create an account with Live Migrations to purchase merchandise. You are responsible for providing accurate, current, and complete billing, shipping, and contact information when placing an order. You authorize us and our service providers, including Printful, to use and share the information reasonably necessary to process, produce, fulfill, deliver, and provide support for your order.
Live Migrations is not responsible for delays, failed delivery, returned shipments, or other losses resulting from inaccurate, incomplete, or outdated information provided by you, including an incorrect shipping address.
Domestic shipping only. Our online store currently offers shipping only to addresses within the United States. If an order is placed using an address that Printful cannot service, the order may be canceled and any applicable refund will be processed in accordance with the applicable payment and refund procedures.
Payment and order acceptance. Merchandise orders are submitted for processing through our online store and applicable third-party payment and fulfillment services. An order confirmation does not necessarily constitute final acceptance of an order. We reserve the right to cancel or decline an order for reasons including, but not limited to, product availability, pricing or listing errors, suspected fraud or unauthorized activity, inability to fulfill an order, or other circumstances beyond our reasonable control.
If an order is canceled after payment has been made, any applicable refund will be issued through the payment method or payment service used for the transaction, subject to applicable payment-provider and refund procedures.
Production and fulfillment. Merchandise is generally produced after an order is placed rather than held in inventory. Because products are made to order, production and shipping times may vary. Any estimated production or delivery date provided at checkout or elsewhere on the website is an estimate and is not a guarantee. Live Migrations is not responsible for delays caused by Printful, shipping carriers, customs, weather, supply-chain disruptions, technical issues, or other circumstances outside our reasonable control.
Returns, refunds, replacements, and damaged products. Because merchandise is produced specifically in response to individual orders, all sales are final. Requests concerning defective, damaged, incorrect, or otherwise improperly fulfilled merchandise may be subject to Printful’s applicable return, replacement, and refund policies.
If you receive merchandise that is damaged, defective, incorrectly produced, or materially different from what you ordered, you should contact us promptly with your order information and, where appropriate, photographs or other documentation of the issue. We will work with Printful, as applicable, to determine whether a replacement, refund, or other remedy is available.
We do not guarantee that every return, refund, replacement, or other remedy will be approved. Any such remedy will be subject to applicable law and the policies and procedures of the relevant payment, fulfillment, and service providers.
Third-party services. Printful and other third-party providers involved in processing, payment, production, fulfillment, or delivery operate independently of Live Migrations. To the extent permitted by law, Live Migrations is not responsible for the independent acts, omissions, policies, systems, or service interruptions of third-party providers. Nothing in these Terms limits any rights or remedies that you may have under applicable consumer protection laws.
Order-related communications. By placing an order, you may receive transactional communications relating to your purchase, including order confirmations, production updates, shipping notifications, delivery information, and communications concerning an order issue. These communications are necessary to administer your purchase and are not necessarily marketing communications.
Allocation of proceeds. By purchasing merchandise through our online store, you acknowledge that you are purchasing retail merchandise and that the purchase price is not a tax-deductible charitable contribution. Merchandise sales are not charitable donations. After deduction of applicable product, fulfillment, payment-processing, shipping, platform, and other costs and expenses associated with merchandise sales, 100% of the resulting net proceeds are used to support the programs, operations, and mission of Live Migrations.
3. Donation Policy
Fiscal sponsorship and donation processing. Donations made through this website to support the work and mission of Live Migrations are made through our fiscal sponsor, Collaborative Earth. Collaborative Earth receives and administers charitable donations on behalf of Live Migrations in accordance with the terms of our fiscal sponsorship arrangement. Live Migrations does not independently process charitable donations made through this website.
By making a financial contribution through this website, you acknowledge that your donation is processed through Collaborative Earth and that the donation may be subject to Collaborative Earth’s applicable policies, procedures, and terms. You represent and warrant that you are authorized to use the payment method provided and that all information submitted in connection with your donation is accurate and complete.
Tax-deductibility. Donations made through our fiscal sponsor are intended to be charitable contributions to the extent permitted by applicable law. Any tax-deductibility of a donation is determined under applicable law and the requirements of Collaborative Earth as the fiscal sponsor. Donors should retain any donation receipt or acknowledgment provided through the donation process for their records and consult their own tax advisor regarding the tax treatment of their contribution.
Refunds. Because charitable donations are generally committed to supporting our nonprofit mission upon receipt, donations made through this website are considered final and non-refundable, except where otherwise required by applicable law or where a refund is appropriate due to an error or unauthorized transaction.
Errors and unauthorized transactions. If you believe that an error was made in processing your donation, that your donation was made in error, or that a transaction was unauthorized, please contact us as soon as possible. We will work with Collaborative Earth and the applicable payment processor, as appropriate, to investigate and resolve the issue.
Use of donations. Donations received through Collaborative Earth for the benefit of Live Migrations will be used to support Live Migrations’ programs, operations, and charitable mission, consistent with the terms of our fiscal sponsorship arrangement and applicable law.
4. Limitation of Liability
Live Migrations provides this website and its content on an “as-is” basis. We make no guarantees that the website will be error-free or uninterrupted. To the fullest extent permitted by law, Live Migrations shall not be liable for any damages arising out of your use of, or inability to use, this website or its products.
5. Governing Law and Jurisdiction
These Terms and Conditions, and any disputes arising out of or related to your use of this website, shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of your use of this site or purchase of merchandise shall be brought exclusively in the state or federal courts located in California.
